1:15-2:30         ACUS 2.0:  The First Recommendations to Emerge from the Reconstituted Administrative Conference of the United States

The Administrative Conference of the United States resumed operation in 2010, after roughly 15 years of desuetude, and has been busy making up for lost time.  The new ACUS issued its first recommendation (on preemption) in December and expects to approve several more at its next plenary session in June.  In this panel, the author of the preemption report and the staff counsel for two other, relatively mature projects, will describe the issues involved and the Conference’s recommendation or likely direction.
