Washington, D.C., June, 29, 2016 – ACUS’s newly adopted Recommendation on Aggregate Agency Adjudication was cited yesterday by Senior U.S. District Judge Jack B. Weinstein in a nationwide consumer class action case. Recommendation 2016-2, based on a report written by Michael Sant’Ambrogio and Adam Zimmerman, provides guidance to agencies on the use of aggregation techniques to resolve similar claims in adjudication. Judge Weinstein’s opinion stated “the newly adopted recommendation presents an important route that will be carefully considered by administrative and other agencies, as well as by the Bench, the Bar, and academia, in connection with mass actions that should be aggregated.”
