Today, both the notice and the comments in a rulemaking proceeding may be electronic. This recommendation provides guidance to agencies on a variety of legal issues that arise from the advent of e-Rulemaking, such as how agencies may use software to determine that submitted comments are identical or nearly identical, and whether agencies can (and should) destroy paper copies of comments scanned to electronic form.
These technological innovations reduce costs, enhance transparency and improve efficiency in government.
