This panel at the ABA Section of Administrative Law and Regulatory Practice's 2014 Administrative Law Conference will discuss how agencies and the public communicate outside formal comments submitted to the docket during informal rulemaking proceedings. Borrowing a term from the judicial context, these communications are often referred to as "ex parte" communications, although the term fits uncomfortably and many agencies do not use it. Emily S. Bremer with moderate the discussion among the four panelists, Amit Narang (Public Citizen), Kathryn Sinniger (Department of Transportation), James J. Tozzi (Center for Regulatory Effectiveness), and Caroline Wehling (Environmental Protection Agency).
